Terms of Use
These Terms of Use ("Terms") govern your access to and use of the QR & Barcode Smart Scan mobile application (the "App"), provided by Lumisphere, a trade name of Kashmira Kikani ("we," "us," "our"). By downloading, installing, or using the App, you agree to these Terms.
1. License
Subject to your compliance with these Terms and the Apple Standard End User License Agreement (EULA), we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control. The Apple Standard EULA applies to your use of the App and is incorporated by reference. Where these Terms and the Apple Standard EULA differ, the more restrictive applies.
2. Acceptable use
You agree not to:
- Use the App to scan or generate codes that infringe intellectual property, violate law, or facilitate fraud or harassment;
- Reverse-engineer, decompile, or attempt to extract source code from the App, except to the extent permitted by law;
- Redistribute, resell, or sublicense the App;
- Bypass or attempt to bypass any subscription or feature gate.
3. Safety-check disclaimer
The App includes a URL safety check that queries Google Web Risk. This check is provided as a convenience only. A "safe" result does not guarantee that a link is trustworthy; a "warning" or "danger" result does not guarantee that a link is malicious. We do not control Google's data. You are responsible for exercising judgment before opening any scanned link.
4. Food nutrition disclaimer
Nutrition information (Nutri-Score, NOVA group, per-100g nutrients, and product names) is sourced from Open Food Facts, a community-maintained open database. Data may be incomplete, out of date, or incorrect. Nothing in the App is medical, dietary, or nutritional advice. Consult product packaging and a qualified professional for anything that matters.
5. Subscription terms
The App offers two auto-renewing subscription plans that unlock unlimited scan history and unlimited QR code generation:
- Pro Monthly — $1.99 USD, billed every month. Local currency and price may vary; the exact amount is shown before you subscribe.
- Pro Yearly — $11.99 USD, billed every year. Local currency and price may vary; the exact amount is shown before you subscribe.
5.1 Free trial
New subscribers are eligible for a 7-day free trial when starting either plan. You will not be charged during the trial. If you do not cancel at least 24 hours before the trial ends, your Apple ID will be automatically charged for the plan you selected, and the subscription will renew on the schedule shown above. If you already used a free trial or introductory offer for this app, you may not be eligible for another.
5.2 Auto-renewal
Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours prior to the end of the current period.
5.3 Managing or cancelling your subscription
You can manage or cancel your subscription at any time by opening iOS Settings → your Apple ID → Subscriptions, or by visiting apps.apple.com/account/subscriptions. Deleting the App does not cancel the subscription.
5.4 Refunds
All purchases are handled by Apple. Refund requests are processed by Apple according to their policies. You may request a refund at reportaproblem.apple.com. Lumisphere cannot issue refunds directly.
5.5 Free trial forfeiture
Any unused portion of a free trial period is forfeited when you purchase a subscription (this rule is set by Apple where applicable).
5.6 Price changes
If we change the price of a subscription, Apple will notify you and, where required, ask you to consent to the new price before the next renewal. Continued use after a required consent constitutes acceptance.
6. Intellectual property
The App, including its code, design, branding, and content we author, is owned by Lumisphere and protected by copyright, trademark, and other laws. Third-party content displayed inside the App (such as Open Food Facts data) remains the property of its respective owners.
7. Third-party services
The App uses Google Web Risk for URL safety and Open Food Facts for food nutrition. Your use of features that rely on these services is also subject to those services' terms. We are not responsible for the availability, accuracy, or behavior of third-party services.
8. Warranty disclaimer
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMISPHERE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP IS LIMITED TO THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
10. Termination
You may stop using the App at any time by deleting it from your device. We may suspend or terminate access to premium features if you violate these Terms. Termination does not, by itself, entitle you to a refund from Apple.
11. Changes to these Terms
We may update these Terms from time to time. The "Effective date" at the top will reflect the most recent version. Continued use of the App after an update constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict-of-law rules, except where consumer protection law of your country of residence provides otherwise.
